TO: Betty Boatman and Equable Ascent Financial LLC:
BE IT KNOWN, that Bank of America, N.A., the above-named Plaintiff, by its attorney, J. Dustin Smith, has filed in the office of the Clerk of the Parke Circuit Court its Complaint against Defendants Betty Boatman and Equable Ascent Financial LLC, and the said Plaintiff having also filed in said Clerk’s office the affidavit of a competent person showing that the residence and whereabouts of the Defendants, Betty Boatman and Equable Ascent Financial LLC, upon diligent inquiry are unknown, and that said cause of action is for default on the promissory note and to foreclose a mortgage on the following described real estate in Parke County, State of Indiana, to wit:
Part of the Southwest Quarter of the Southwest Quarter of Section Twenty-nine (29), Township Fourteen (14) North, Range Eight (8) West, 2nd P.M., Florida Township, Parke County, Indiana. Also being a part of a tract of land owned by Woodrow P. Boatman, Sr. as shown on a survey recorded on April 2, 1993 in Vol. 66, Page 581 In the records of the Parke County Recorder’s Office. More Particularly described as follows:
Commencing at a stone located at the Northwest corner of the Southwest Quarter of the Southwest Quarter of Section Twenty-nine (29), Township Fourteen (14) North, Range Eight (8) West, 2nd P.M. Thence EAST (N 90 degrees 00 minutes 00 seconds E) (Assumed Bearing) on the North line of said Southwest Quarter of the Southwest Quarter, Nine Hundred Thirty and Zero hundredths (930.00) feet to a 1″ diameter iron pipe located at the Northwest corner of the aforementioned Boatman property. Said 1″ diameter iron pipe being the point of beginning of this description. Thence continuing East on the North line of said Quarter Quarter, One Hundred Three and Fifteen hundredths (103.15) feet to a 5/8″ iron rod located on the top of the East bank of an existing creek, thence South Zero degrees, Five minutes, Thirteen seconds West, Eight Hundred seventy-one and Fifty-five hundredths (871.55) feet to a 5/8″ iron rod, thence South Two degrees, Fourteen Minutes, Forty seconds East, Four Hundred Thirty-two and Thirty-seven hundredths (432.37) feet to a 5/8″ iron rod, thence South Zero degrees, Eleven minutes, Eleven seconds West, Twenty and zero hundredths (20.00) feet to the centerline of County Road 1000S, thence North Eighty-nine degrees, Fifty-nine minutes, Five Seconds West along the centerline of County Road 1000S, One Hundred Twenty-three and Zero hundredths (123.00) feet, thence North Zero degrees, Eleven minutes, Eleven seconds East on the West line of said Boatman property and on the East line of a tract of land owned by William Rhuebottom as shown on the previously mentioned 1993 survey, Twenty and Zero hundredths (20.00) feet to a 1″ diameter iron pipe, thence continuing on said line North Zero degrees, Eleven minutes, Eleven seconds East, One Thousand Three Hundred and Fifty-seven hundredths (1303.57) feet to the point of beginning.
Containing 3.26 acres more or less.
Included is a manufactured home.
Commonly known as 4796 West 1000 S, Rosedale, IN 47874.
NOW, THEREFORE, said Defendants are hereby notified of the filing and pendency of said Complaint against them and that unless they appear and answer or otherwise defend thereto within thirty (30) days after the last notice of this action is published, judgment by default may be entered against said Defendants for the relief demanded in the Complaint.
