Legal Notice – Ordinance 2023-13, Shacks During the Parke County Covered Bridge Festival
Ordinance 2023-13
AN ORDINANCE SETTING DEADLINES FOR PLACEMENT AND REMOVAL OF TRAILERS/SHACKS FROM COUNTY PROPERTY DURING THE PARKE COUNTY COVERED BRIDGE FESTIVAL
WHEREAS, the Parke County Covered Bridge Festival begins the second Friday of October each year in Parke County, Indiana; and
WHEREAS, the Parke County Board of Commissioners is responsible for the upkeep and maintenance of county-owned property, including the Parke County Courthouse and the Parke County Courthouse lawn; and
WHEREAS, as part of the Parke County Covered Bridge Festival activities the Parke County Board of Commissioners allows non-for-profit organizations to place trailers/shacks on the courthouse lawn for the sale of certain items and or food; and
WHEREAS, in recent years there has developed a problem with organizations failing to remove said trailers/shacks from the courthouse lawn in a timely manner; and
WHEREAS, the Parke County Board of Commissioners has determined that public welfare is benefitted by a deadline for the placement and removal of trailers/shacks from the courthouse lawn; and
NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of Parke County, Indiana:
- That upon passage of this ordinance and publication thereof, it shall henceforth beprohibited for an individual or group to leave their trailer/shack on the courthouse lawn, without the expressed authorization of the Parke County Board of Commissioners, past the third Wednesday following the last day of the Parke County Covered Bridge Festival each year; and
- That no trailer/shack shall be placed on the courthouse lawn prior to the Friday before the canopy tent is set up on the courthouse lawn, without the expressed permission of the Parke County Board of Commissioners; and
- That failure to abide by said ordinance may result in the citation of a Class C Infraction with a fine of a sum not to exceed $500 per day, each day shall constitute a separate violation of this ordinance.
Unanimous consent of Parke County Commissioners who were present on the 4 day of December 2023 to consider the ordinance on the same date as introduced.
