ORDINANCE 2023-10

 

WHEREAS, the Town Council of Rockville, Indiana is given the authority under Indiana law to govern, establish, and enforce laws within the town limits of the Town of Rockville, Indiana; and

 

WHEREAS, the Town Council of Rockville, Indiana has recently authorized the installation of electric vehicle charging stations throughout the Town of Rockville, Indiana; and

 

WHEREAS, the amount of vehicle charging stations within the town limits of the Town of Rockville, Indiana is limited and may at times be in high demand; and

 

WHEREAS, the Town Council of the Town of Rockville, Indiana desires to ensure that access to said charging stations is managed efficiently; and

 

WHEREAS, no previously adopted Rockville Town Ordinance currently governs the use of electric vehicle charging stations within town limits.

 

NOW THEREFORE BE IT ORDAINED by the Town Council of the Town of Rockville, Indiana, that upon passage of this ordinance, due publication of this notice as required by I.C. 5-3-1 that:

 

  1. Electric vehicle charging stations, where provided for public use, are reserved for parking, and charging electric vehicles only; and
  2. Electric vehicles may still be parked in any space designated for public parking, subject to the restrictions that would apply to any other vehicle that would park in that space; and
  3. No person shall stop, stand, or park any non-electric vehicle or place any other item/obstruction in a space designated through signage as an electric vehicle charging station.
  4. Any non-electric vehicle parked in a duly designated electric vehicle parking space may be subject to removal at the vehicle owner’s expense.
  5. Any electric vehicle parked in an electric vehicle parking space that is signed exclusively for electric vehicle charging and that either (a) is not electrically charging or (b) is parked beyond the days and hours designated on regulatory signs posted at or near the parking space shall be subject to removal at the vehicle owner’s expense.  For the purpose of this section “charging” means an electric vehicle is parked at an electric vehicle charging station and is connected to the charging station equipment and receiving a charge to their vehicle.
  6. Electric vehicle charging stations, other than private property, shall have posted signage, as identified in this ordinance, allowing only charging electric vehicles to park in said electric vehicle charging spaces.
  7. Posted signage shall include information on the charging station to identify voltage and amperage levels, any time of use restrictions, fees, or safety information.

 

Violators of this ordinance may be towed at the vehicle owner’s expense and shall be charged with a class C infraction with fines imposed up to $500.
