NOTICE OF SUIT

To the   defendants   named   below   herein,  and  any  other   person  who   may  be concerned.  You are notified that you have been sued in the Court named above.

The nature of the suit is the Complaint  to Quiet Title upon the property located in Parke County  at 304 Howard  Ave, Indiana to wit:

Parcel I:

Part of the Northwest  Quarter (NW1/4) of Section Seven (7), Township  Fifteen (15) North, Range Seven (7) West and more definitely bounded  as follows, viz: Commencing at the southeast corner of a certain tract of real estate conveyed  by Alvah Hesler to Guy Harmless and wife (see Deed Record Vol. 96, page 470, in the office of the Recorder of Parke County, Indiana): thence north along the east line of said Harmless tract two hundred  fifty-seven (257) feet to a stake; thence east along the south line of said Harmless  tract one hundred fifty (150) feet; thence due south ninety-eight (98) feet for a place of beginning; (same being the northwest corner of a tract of real estate formerly owned by J. M. Johns); thence south and along the west line of said J. M. Johns tract two hundred  eighty-six (286) feet to Howard  Avenue in the Town of Rockville,  Indiana; thence

in a northwesterly course along said Howard  Avenue one hundred  (100) feet and six (6) inches to a stake; thence in a northerly direction two hundred three (203) feet, more or less, to a point eighty (80) feet west to the place of beginning;  thence east eighty (80) feet to the place of beginning.

EXCEPT, A part of the Northwest Quarter of Section 7, Township  15 North, Range 7

West, Parke County, Indiana and being that part of the grantors’ land lying within the right of way lines depicted on the attached Right of Way Parcel Plat marked Exhibit “B”, described as follows: Commencing at the northwest corner of said section, designated as point “801” on said plat; thence north 89 degrees 10 minutes 26 seconds East 115.62 feet along the north line of said section to the centerline of Howard Avenue; thence South 50 degrees 52 minutes 52 seconds East 1,349.13 feet along the centerline of said Howard Avenue to the point designated as “301” on said plat; thence South 50 degrees 49 minutes 59 seconds East 418.63 feet along said centerline to the prolonged west line of the grantors’ land and the point of beginning of this description: thence North 1 degree 02 minutes 32 seconds West 39.28 feet along prolonged west line and the west line of the grantors’ land; thence South 50 degrees 49 minutes 59 seconds East 102.29 feet to the east line of the grantors’ land; thence South 1 degree 04 minutes 17 seconds West 38.12 feet along said  east line and said east line prolonged to the centerline of said Howard Avenue; thence North 50 degrees 49 minutes 59 seconds West 100.45 feet along said centerline to the point of beginning and containing 0.070 acres, more or less, inclusive of the presently existing right of way, which contains 0.031 acres, more or less, as shown in Warranty Deed, recorded August 2, 2017 as Instrument No. 20171635 in the office of the Recorder of Parke County, Indiana.

 

Parcel II:

Also, the right of ingress and egress over and on a strip of land nine (9) feet wide lying immediately west and adjoining the above described tract for driveway purposes, to be used in connection with the above described tract.

This summons by publication is specifically directed to the following defendants who may claim some interest in the Real Estate and whose whereabouts are not known with certainty:

 

And any other persons claiming an interest in the real estate described herein

 

You must respond to this summons by publication, by you or your attorney, on or befoe thirty (30) days after the Third Notice of suit has been published. If you fail to do so, a default judgment maybe entered against you-for the relief demanded in the Complaint.
