Ordinance 2026 – 08

WHEREAS, the governance of the Town of Rockville, Indiana, is vested in the Town Council of Rockville, Indiana, under the Indiana Code 36-1-3.

 

WHEREAS, the Town Council is responsible for and has the authority to regulate and enforce the Fire Prevention Code in the town limits of Rockville, Indiana, in accordance with Indiana law; and

 

WHEREAS, Indiana law is continually changing, and it is necessary to update the Rockville Town Ordinances to remain current; and

 

Now, therefore, Be it ordained by the Town Council of the Town of Rockville, Indiana, that upon passage of this ordinance and due publication of this notice as required by I.C. 5-3-1, that:

Title IX: General Regulations

 

Chapter 97: Fire Prevention Code

 

Article 1: General Provisions

 

Sec. 97-01 Title

 

This Fire Prevention Code and all material included herein by reference shall be known as the “Fire Prevention Code of the Town of Rockville, Indiana.”

 

Sec. 97-01.1 Purpose

 

  1. The purpose of this Fire Prevention Code is to prescribe regulations consistent with the nationally recognized standards for the protection of life, environment, and property from fire, explosions, and hazards arising from the storage, handling, and use of hazardous substances; from conditions hazardous to life or property in the use or occupancy of new or existing buildings and premises; and to establish appropriate administrative procedures for the enforcement of this Fire Prevention Code.
  2. There is adopted by Council, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that a certain Code known as the most recently adopted version of the Indiana Fire Code and any amendments thereto, and the whole thereof, save and accept such portions as are hereinafter deleted, modified or amended and the same is hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this Fire Prevention Code shall take effect, the provisions thereof shall be controlling within the Town.

 

Sec. 97-01.2 Authority

The Fire Chief, or his designee, is hereby authorized and directed to administer and enforce all the following with the aid of, but not limited to, the Council of the Town of Rockville and the Town Attorney:

  1. All provisions of this Fire Prevention Code
  2. It shall be the duty and responsibility of the Fire Chief, Chief of the Fire Prevention Division, or such officer or designee who is ex officio assistant to the State Fire Marshal under I.C. 36-8-17-5(a), to enforce the provisions of this code.
  3. The Fire Chief, Fire Inspectors, or their designees are hereby appointed as Assistant Building Officials for the purpose of assisting the local building department when needed to enforce the Indiana Building Code.

 

Sect. 97-01.3 Exceptions

The provisions of this chapter shall not apply to one- or two-family dwellings in the normal use or maintenance thereof, except whenever the activity or use of such dwellings creates a distinct fire hazard to the life or property of others or creates a hazard to the environment.

Sec. 97-01.4 Scope

The provisions of this Fire Prevention Code are supplemental to the Indiana General Administrative Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, and Indiana Fuel Gas Code as adopted by the Indiana Fire Prevention and Building Safety Commission. The provisions of this Fire Prevention Code apply to the maintenance of Fire Prevention and Life Safety Features as herein described. The provisions of this Fire Prevention Code apply to existing conditions as well as to the conditions arising after the adoption thereof. Buildings, systems, uses, processes, and equipment legally in existence on the effective date of this Fire Prevention Code shall be permitted to continue so long as they are maintained in a condition that is equivalent to the quality and fire-resistive characteristics that existed when the building was constructed, altered, added to, or repaired.

Sec. 97-01.5 Conflicting Provisions; Severability

  1. If any provision of this Fire Prevention Code is found to be in conflict with any Building, Zoning, Safety, Health, other applicable laws or ordinances of the Town of Rockville, Indiana, whether existing on the effective date of this Fire Prevention Code or later adopted, the provision which establishes the higher standard for the promotion and protection of the safety and welfare of the public applies.
  2. If any provision of this Fire Prevention Code is declared invalid by a court or governing board or administration of competent jurisdiction, for any reason, the remaining provisions shall not be affected, if such remaining provisions can, without the invalid provisions or provisions, be given their original intended effect in adopting this Fire Prevention Code. To this end, the provisions of this Fire Prevention Code are severable.

 

Sec. 97-01.6 Minimum Standards

  1. All rules of the Indiana Fire Prevention and Building Safety Commission as set out in Articles 12, 13, 18, 22, and 25 of Title 675 of the Indiana Administrative Code are incorporated in this Fire Prevention Code and shall include all later amendments to that article as published in the Indiana Register or the Indiana Administrative Code with effective dates as fixed therein.
  2. Any special processes or procedures not addressed in the Indiana Fire Code (675 lAC 22) or this Fire Prevention Code shall be subject to applications found in Fire Safety Standards recognized by Indiana Fire Code (6751AC 22), Referenced Standards, and as approved by the Fire Chief, or their designee.
  3. Any special processes or procedures not addressed in this Fire Prevention Code shall be subject to applications found in the current editions of the National Fire Protection Association (NFPA) Standards or other recognized Fire Safety Standards- subject to the rules of the Indiana Fire Prevention and Building Safety Commission.

 

Sect. 97-01.7 Effect of Adoption on Prior Fire Prevention Code

The expressed or implied repeal or amendment by this Fire Prevention Code of any other ordinance or part of any other ordinance does not affect any rights or liabilities accrued, penalties incurred, or proceedings begun prior to the effective date of this Fire Prevention Code. Such rights, liabilities, and other proceedings are continued, and penalties shall be imposed and enforced under the repealed or amended ordinance as if this Fire Prevention Code had not been adopted.

Sec. 97-01.8 Liability

Approval, as a result of an inspection, shall not be construed as an approval of a violation of the Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other Fire Safety Code of the jurisdiction. Inspections presuming to give authority to violate provisions of the Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other Fire Safety Code of the Jurisdiction shall not be valid.

Sec. 97-01.9 Definitions

For the purpose of this Chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning:

Building Code. Means the Indiana Building Code found within 675 IAC 13.

Certificate of Occupancy. A certificate issued by the Rockville-Adams Township Fire Department to the owner or tenant of a structure indicating that the building is in proper condition to be occupied.

Class 1 Structure. Has the meaning ascribed thereto in I.C. 22-12-1-4

Class 2 Structure. Has the meaning ascribed thereto in I.C. 22-12-1-5

Commission. Refers to the Indiana Fire Prevention Building Safety Commission as established by I.C. 22-12-2-1

Division of Fire and Building Safety. Refers to the Division of Fire and Building Safety of the Indiana Department of Homeland Security, established pursuant to I.C. 10-19-7-1

Fire. A rapid oxidation process, which is a chemical reaction resulting in the evolution of light and heat in varying intensities…

Fire and Life Safety Inspection. An inspection of the premises by the Fire Department to verify compliance with standards intended to safeguard persons from fire hazards and from other fire-related hazardous conditions.

Fire Apparatus. Vehicles owned and/or operated by the Rockville-Adams Township Fire Department, to include but not limited to pumpers, aerial ladder trucks, rescues, or other firefighting or rescue equipment.

Fire Chief. Means the chief officer of the fire department or fire territory serving the jurisdiction.

Fire Code. Refers to the Indiana Fire Code found within 675 IAC 22.

Fire Department. Means the Rockville-Adams Township Fire Department.

Fire Hazard. Any situation, process, material, or condition that can cause a fire or explosion or that can provide a ready fuel supply to augment the spread or intensity of a fire or explosion, all of which pose a threat to life or property.

Fuel Gas Code. Refers to the Indiana Fuel Gas Code found within 675 IAC 25

General Administrative Rules. Means the General Administrative Rules of the Indiana Fire Prevention and Building and Safety Commission, located at 675 IAC 12

Hazardous Condition. Presence of structural condition, equipment, utility connection, or materials that constitute or pose a recognized threat of fire or fire-related injury to persons or property.

lAC. Means the Indiana Administrative Code

I.C. Means the Indiana Code of the Indiana General Assembly

Inspection.  Visual inspection of a building, system, design, or installation to verify that it meets the standards of all applicable codes of the jurisdiction relating to fire prevention, and/or is in an acceptable operating condition and free of defects as this may relate to fire prevention.

Key Box. Has the meaning ascribed thereto in 675 IAC 22

Mechanical Code. Means the Indiana Mechanical Code found within 675 IAC 18

Municipality. The town of Rockville, Indiana.

Notice of Violation. Means a written notice issued by the Fire Department usually in the form of an inspection report listing violations.

Occupancy Load. The number of persons for which the means of egress of a building or portion thereof is designed.

Occupancy Classification. Occupancy classification shall be as specified in the Indiana Building Code in effect at the time of construction, alteration, or change of occupancy.

Order. A written report that orders the property owner, occupant, or tenant to cease and correct identified violations of the Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, or this Fire Prevention Code, as these codes may relate to fire prevention and safety.

Owner. Has the meaning ascribed thereto in 675 IAC 22

Person. Has the meaning ascribed thereto in I.C. 22-12-1-18

Qualified Person. Means a person who either holds a current NationalInstitute for Certification in Engineering Technologies (NICET) certification in the fire protection system being installed, serviced, or repaired, or has completed a course of instruction specific to the equipment being installed, serviced, or repaired. Such instruction shall have been approved by the manufacturer of the equipment or their authorized representative.

Testing. A functional test of all components to verify proper operation of the system, design, installation, or use.

TERMS NOT DEFINED: Where terms are not defined in this Fire Prevention Code and are defined in the General Administrative Rules, the Indiana Building Code, Indiana Fire Code, Indiana Mechanical Code, or Indiana Fuel Gas Code, such terms shall have the meanings ascribed to them as in those codes. Where terms are not defined through the methods authorized, such terms shall have ordinarily accepted meanings such as the context implies.

Article 2: Administration and Enforcement

Sec. 97-02 Fire Scene Authority

The Fire Chief, or their designee, at any fire, explosions, rescue, emergency medical or hazardous material incident, or any other emergency which poses imminent threat to life, environment, or property, shall have the authority to direct operations as necessary to control, mitigate, or eliminate the emergency. It shall be unlawful for any person to impede the emergency operations of the Fire Department.

Sec. 97-02.1 Emergency Lines and Limits

  1. The Fire Chief, or their designee, may establish emergency lines and limits, and barricade or guard from the general public such emergency lines and limits. The Fire Chief, or their designee, may create an area in which only firefighters; law enforcement personnel; other emergency responders; other people, or agencies having a direct interest in any property threatened by a fire, explosion, hazardous material incident, or other emergency, or other people, or agencies at the discretion of the Fire Chief, or their designee, shall be admitted. It shall be unlawful for any unauthorized person to cross such emergency lines or limits.
  2. The establishment and marking of emergency fire lines shall be in accordance with the provisions of any city ordinances providing for the establishment and marking of “no parking zones” which are in force at the time of the establishment and or marking of the emergency fire lanes. The parking, stopping, or placing of any personal property, specifically motor vehicles, or any other means of blocking or obstructing fire lanes shall be in direct violation of this chapter.
  3. Fire lanes shall be provided and maintained in accordance with the provisions of Appendix A, titled “Requirements for Fire Lanes.”

 

Sec. 97-02.2 Enforcement Authority

  1. The Fire Chief, or their designee, shall possess the authority to enforce the provisions of this Fire Prevention Code. The Fire Chief, or their designee, shall have the authority to enforce provisions of the Indiana General Administration Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other rule of the Commission. Such enforcement shall include, but is not limited to:

(1) The prevention of fires;

(2) The handling, storage, sale, and use of flammable liquids, explosives, combustible, and hazardous materials;

(3) The adequacy of means of egress from all places in which numbers of people live, work, or congregate from time to time for any purpose;

(4) The location, installation, and maintenance of smoke alarms, fire alarm systems, and fire suppression systems; and

(5) The existence of recognized hazardous conditions that present a clear and immediate hazard to life and property.

  1. The Fire Chief, or their designee, shall have the authority to institute actions in cases of non-compliance, in accordance with locally prescribed avenues covering the violations of the Indiana General Administrative Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other rule of the Commission. Violators of this Fire Prevention Code may be cited in the Parke County, Indiana Circuit Court.
  2. The Fire Chief may designate up to two (2) members of the Fire Department as inspectors, as shall from time to time be necessary, whose duties shall include the implementation and enforcement of the Fire Prevention Code.
  3. The Fire Chief shall compile a monthly report for all the activities as they relate to the Fire Prevention Code. This report shall be presented to the Town Council no later than the first meeting of each month.
  4. The Fire Department shall have the authority to enter any building or premises without permission or warrant in the event of an emergency situation constituting a threat to life, property, or the public safety for the purpose of eliminating, controlling, or abating the hazardous condition or situation.
  5. At no time will the Fire Department or any of its agents be responsible for any damages as a result of an emergency entry or damages as a result of eliminating, controlling, or abating the hazardous condition or situation. The Fire Department will reasonably attempt to notify the owner, as well as the operator, occupant, or other person responsible for the building or property of such an event, and it will be the responsibility of the owner, occupant, or tenant to ensure that the building is re-secured.

 

Sec. 97-02.3 Imminent Danger

  1. The Fire Chief, or their designee, may stop an operation by issuing a cease-and­ desist order and/or require the evacuation of any Class 1 structure or portion thereof under the provisions of I.C. 36-8-17-9 when it is determined that conduct or conditions of the property:
  2. Present a clear and immediate hazard of death or serious bodily injury to any person other than a trespasser; or
  3. Will conceal a violation of the law
  4. In the event a cease-and-desist order is issued under subsection (a), operations may not continue in/on the premises until such time that the Fire Chief, or their designee, establishes that adequate remediation of the hazard has been implemented. Failure to abide by a cease and desist order may result in fines of up to One Hundred Dollars ($100) per day of the offense.

 

Sec. 97-02.4 Open Burning

Open burning shall be regulated by the Fire Chief, or their designee, the Town Council of Rockville, and any applicable EPA rules or restrictions. When allowed, burning shall conform to the following:

  1. The Fire Chief, or their designee, may prohibit any fire, use of fire, or use of any pyrotechnic devices when atmospheric conditions, weather conditions, or local conditions make such use hazardous
  2. The burn area is not within twenty (20′) feet of any structure, property line, vehicle, or right of way
  3. The burn area is surrounded by a fire ring no less than one (1′) foot in height, or the burn area is suspended at least one (1′) foot above ground
  4. When allowed, burning shall be between the hours of 8:00 a.m. and 11:00 p.m.
  5. The fire shall not be more than three (3′) feet in diameter and three (3′) feet high
  6. Fire shall consist of dry firewood. Flammable liquids or accelerants shall not be used to ignite said fire
  7. Fire shall be constantly attended by someone over the age of eighteen (18) and by a competent person with a readily available means of extinguishment
  8. If a fire creates an air pollution problem, a nuisance to neighbors, or a fire hazard, it shall be promptly extinguished upon request by the Fire Department
  9. If any governmental entity issues a burn ban, for any reason, no outdoor fires for cooking purposes shall be permitted.
  10. Nothing in this Section allows burning of trash, garbage, waste materials or substances, and leaves.
  11. It shall be the duty of the Rockville Police Department to enforce violations of this section

Article 3: Emergency Planning

Sec. 97-03 Child Daycare Emergency Evacuation Plan Required

All residential day care, childcare, and pre-school facilities shall register with the Rockville-Adams Township Fire Department annually. In addition, said facilities shall provide a floor plan of the structure on a minimum size of 8 1/2″ x 11″ graph-style paper that also sufficiently indicates all exit locations, sleeping areas, fire extinguishers, and utility shut-offs.

Sec. 97-03.1 Apartment Complex Registration

  1. Registration of all apartment complexes containing three or more units shall include the following information:
  2. Names, address, and telephone number of owner, manager, or agent representing the apartment complex.
  3. A diagram of the complex on a minimum size of 8112″ x 11″ graph-style paper that sufficiently indicate all exit locations and utility shut-offs.
  4. The type and general location of all heating appliances
  5. The registration shall be maintained as current until:

 

(a) A change of ownership

 

(b) A change of interior layout of more than one apartment

(c) Addition or alteration of the building that would change the required diagram. B. Inspection of all apartment buildings by the Fire Prevention Division shall include, but not be limited to, utility shut-offs, mechanical heating appliances, and general common areas within the building. 1. Where access to items required for inspections is entered into a private residence, the Fire Department shall give ten (10) days’ notice prior to inspection.

  1. The time and day of the inspection may be done at the convenience of the resident.
  2. Private resident inspection shall be made only at the request of the resident.
  3. Inspection may be made of a vacant apartment during a regular inspection of the apartment complex.

Article 4: Fire Service Features

Sec.97-04 Key Boxes

  1. Any new Class 1 structure that is protected by an automatic sprinkler system or fire alarm system, which sends a localor transmitted signal, and access to, or within such structure, or an area on that property is unduly difficult because of secure openings, and where immediate access is necessary for lifesaving or firefighting purposes or property preservation, the Fire Chief, or their designee shall require a key box to be installed in an approved location(s). The key box product manufacturer must be approved by the Fire Chief, or their designee.
  2. Any existing Class 1 structure that has gone through more than 25% of a building renovation shall comply with this article.
  3. The key box shall contain keys for the following:
  4. Main entrance door
  5. Fire Alarm Control Panel
  6. Mechanical rooms
  7. Sprinkler control rooms
  8. Electrical rooms
  9. Special keys to reset pull stations or other fire protection devices
  10. Elevator keys, if required
  11. All other rooms as specified during the plan review
  12. All keys shall be labeled to be easily identifiable by fire personnel
  13. When key boxes are required for immediate access to Class 1 structures, for life safety, firefighting, or alarm activations, the Fire Chief, or their designee, shall approve the type and location of such box. The key box shall be obtained through Knox Box.
  14. Violations of this article may result in fines up to twenty-five ($25) per day.

Sec.97-04.1 False Alarms

After written notification to owners or operators of nuisance alarms (those alarms that malfunction over ten (10) times in a one-year period, or over three (3) times in a thirty­ day (30) period) by the Fire Chief, or their designee, there shall be a fine imposed on the owner or operator of the building. The fine imposed on the owner or operator of the building will be Fifty Dollars ($50), starting with the eleventh (11th) alarm in the one-year period.

There shall be a fine imposed on the owner or operator of the building of Fifty Dollars ($50) starting with the fourth (4th) alarm in the Thirty-Day (30) period. Each alarm after the Eleventh (11th) or the Fourth (4th) alarm, respectively, shall constitute a separate fine of Fifty Dollars ($50).

Sec. 97-04.2 Class 1 Structure Identification

In addition to Class 1 structures as required by the Indiana Fire Code and this Fire Prevention Code, all new and existing Class 1 structures shall have approved numbers or addresses placed in such a position as to be visible and legible from the street or road fronting the property. Said numbers shall contrast with their background.

Article 5: Fire Protection Systems

Sec.97-05 Fire Hydrants

No person shall block or obstruct from view, by means of plants or vegetation, vehicles, or personal property, any fire hydrant, Fire Department Connection (FDC), indicator valve, or other appliance required for use by the Fire Department. The parking, stopping, or placing of any personal property, including motor vehicles, or any other means of blocking or obstructing fire hydrants, Fire Department Connections, indicator valves, or required appliances shall be a direct violation of this chapter.

Sec. 97-05.1  Fire Department Connections

The location of the fire department connections shall be approved by the Fire Chief, or their designee, with respect to fire hydrants, fire department access roads, fire apparatus water supply lines, buildings, utilities, and landscaping. Immediate access to fire department connections shall be maintained at all times and not hindered by obstructions, including fences, bushes, trees, walls, or other fixed or removable objects.

Sec.97-05.2 Fire Extinguishers 

Portable fire extinguishers shall be installed and maintained in Class 1 structures as set forth in the referenced edition of NFPA 10 as published by the National Fire Protection Association.

  1. Any Class 1 structure that has a fire extinguisher that is 5.0 lbs. or less does not need to be serviced by a licensed Fire Protection Company
  2. Fire extinguishers that are 5.0 lbs. or less shall be checked on a monthly basis and have a fire extinguisher tag located on the extinguishers
  3. Fire extinguishers that are 5.0 lbs. or less have a ten (10) year lifespan and must be replaced ten (10) years after the date on the extinguishers
  4. If a fire extinguisher is used, it must be replaced by either a new extinguisher or refilled by a licensed Fire Protection Company

 

Sec.97-05.3 Qualified Contractors

Prior to performing installation, service, repair, inspection, or maintenance of fire protection systems, the qualified person conducting such function(s) shall have all available, upon request of the Fire Chief, or their designee, verifying certification, for the company or individual, for each type of fire protection system being installed, serviced, repaired, inspected, or maintained. Certification shall conform to the requirements as outlined in each applicable NFPA standard or by the manufacturer of such equipment.

Article 6: Inspections; Fees and Costs

Sec.97-06 Fire Investigations

The Fire Chief, or their designee, shall perform fire investigations pursuant to I.C. 36-8-17-7. The Fire Chief, or their designee, is authorized to conduct an origin and cause investigation of all fires and explosions within the service district of the Fire Department. It shall be unlawful for any person to impede the Fire Chief or their designee from conducting an origin and cause investigation.

Sec.97-06.1 Fire and Life Safety Inspections

The Fire Chief, or their designee, shall conduct fire and life safety inspections in Class 1 structures pursuant to I.C. 36-8-17-8, with the exception that all Class 1 structures defined as R-2 “Apartment Houses” in the most recently adopted version of the Indiana Fire Code by the State of Indiana, consisting of few than ten (10) dwelling units, shall be exempt from annual fire inspections. The Fire Chief, or their designee, shall inspect Class 1 structures as often as necessary for ascertaining and causing to be correct any violation of the Indiana General Administrative Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other rules of the commission. A re-inspection may be necessary to confirm compliance with a Notice of Violation or any order issued by the Fire Chief or their designee. However, no non­ exempt Class 1 structure may be inspected more than twice in a calendar year other than for the purpose of ascertaining the abatement of a previously determined deficiency, except that an inspection of any Class 1 structure may occur upon the request of an owner or occupier of the Class 1 structure or upon any complaint received by the Town. In the event an exempt Class 1 structure is inspected at the request of an owner, annual inspection fees shall be assessed in accordance with Sec. 97-06.11

Sec. 97-06.2 Inspections

  1. Plans for new construction or work for which Fire Department approval is required shall be filed with the Fire Department before the issuance of any construction permits. The plans should be submitted by hard copy with a minimum size of 24″ x 36″ or site-appropriate dimensions. No Class 1 structure shall be exempt from new construction inspections. This provision shall in no way replace or satisfy any plan review process(es) as required by the State.
  2. It shall be the duty of the permit holder or contractor to cause the work to remain accessible and exposed for inspection purposes. Neither the Fire Chief, or their designee, nor the Town shall be liable for expenses entailed in the removal or replacement of any material required to allow inspection. It shall be the duty of the person requesting any required inspections to provide access to and means for proper inspection of such work. Required inspections for new construction include, but are not limited to:

(1) Site;

(2) Rough-in;

(3) Sprinkler system rough-in; (4) Fire alarm rough in;

(5) Above ceiling; (6) Pre-final;

(7) Sprinkler system final;

(8) Fire alarm final;

(9) Existing Building Inspections

 

  1. This Fire Prevention Code shall not be construed to hold the Town of Rockville, any officer, or employee responsible for any damage to persons or property by reason of the inspection authorization herein provided or by reason of the approval or disapproval of any equipment or process authorized herein.
  2. It shall be unlawful for any person to prevent, interfere with, or in any manner hinder the Fire Chief, or their designee, while engaged in the discharge of his/her inspection duties.
  3. Local fire codes in accordance with the provisions of Appendix B, titled “Fire Inspection Checklist- Local Codes.”

Sec. 97-06.4 Food Truck Inspection

The Rockville-Adams Township Fire Department is responsible for inspecting food trucks that are serving in the incorporated Town of Rockville. The Rockville-Adams Township Fire Department will inspect these items on all food trucks:

  1. Fire Extinguishers
  2. A mounted ABC Fire Extinguisher, 10 lb.
  3. New within the last twelve (12) months, or tagged by a licensed Fire Protection Company within the last twelve (12) months
  4. A mounted Class K Fire Extinguisher, 6 liter
  5. New within the last twelve (12) months, or tagged by a licensed Fire Protection Company within the last twelve (12) months
  6. Extension Cords
  7. No use of extension cords or other electrical hazards
  8. Automatic Suppression System
  9. Must be tagged by a licensed Fire Protection Company within the last twelve (12) months
  10. The hood shall be cleaned according to IFC, Chapter 6, Section 609, or NFPA 96
  11. Generators
  12. Must be isolated from contact with the public by using fencing, an enclosure, or other approved method
  13. Gaseous Cylinders
  14. Required to be locked and secured in an upright, fixed position.
  15. Parking
  16. All food trucks shall maintain a distance of ten (10) feet or more from any other structure.
  17. Fees
  18. Food truck inspection fees shall be in accordance with Sec. 97-06.14

The Fire Chief, or their designee, shall have the authority to enforce provisions of the Indiana General Administration Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other rule of the Commission that has to deal with Sec. 97-06.4

Sec. 97-06.5 Festivals Inspection

The Rockville-Adams Township Fire Department shall have the right to inspect any festivals that are held in the incorporated Town of Rockville. The Rockville-Adams Township Fire Department will inspect these items during any festival:

  1. Fire Extinguishers
  2. A minimum of a 2 1/2 lb. ABC fire extinguisher is required for all vendors
  3. Class K extinguisher is required for any vendor using cooking oil
  4. New within the last twelve (12) months, or tagged by a licensed Fire Protection Company within the last twelve (12) months
  5. Gas Cylinders
  6. All gaseous cylinders are required to be locked and secured in an upright, fixed position
  7. Gaseous cylinders not in use must have a valve protector in place
  8. Flame under tent
  9. No open flame under non-fire-retardant tents
  10. Generators
  11. Must be isolated from contact with the public by using fencing, an enclosure, or other approved method
  12. Extension cords
  13. If extension cords are used, they must be UL-approved
  14. No daisy-chaining extension cords shall be allowed
  15. Fees
  16. Festival inspection fees shall be in accordance with Sec. 97-06.14

The Fire Chief, or their designee, shall have the authority to enforce provisions of the Indiana General Administration Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other rule of the Commission that has to deal with Sec. 97-06.5

 

Sec. 97-06.6 Certificate of Occupancy

Before the issuance of the Certificate of Occupancy by the Rockville-Adams Township Fire Department for a Class 1 structure, the Fire Chief, or their designee, shall conduct a Final Inspection. All Fire Protection Systems shall be successfully inspected and tested as necessary.

Sec. 97-06.7 Determination of Violation

Whenever the Fire Chief, or their designee, determines by inspection that an apparent or actual violation of the Indiana General Administrative Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, any other rule of the Commission or a hazardous condition exists upon any Class 1 structure within the Town of Rockville, Indiana, the person making such determination shall issue such Notice of Violation or order as may be necessary for the enforcement of the Indiana General Administrative Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other rule of the Commission.

Sec. 97-06.8 Notice of Violation

  1. Under I.C. 36-8-17-9, an order of enforcement of the Indiana General Administrative Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other rule of the Commission, which is within the jurisdiction of the Fire Chief, or their designee, may seek the correction of any violation or the elimination of any hazardous condition by the methods specified in this Fire Prevention Code or by any other appropriate remedy or procedure provided by law. The failure of the Fire Department to inspect or to issue a Notice of Violation or order in accordance with this Fire Prevention Code shall not constitute approval of any violation or noncompliance.
  2. Any Notice of Violation or order issued pursuant to this section shall be conveyed upon the owner, operator, occupant, or other person responsible for the building or property. Conveyance of such order shall be by one of the following methods: Personal service (by affixing a copy thereof in a conspicuous place at the entrance of said building or premises), by mailing a copy thereof to such responsible person by first-class mail to his or her last known address, by fax, or electronic mail pursuant to I.C. 4-21.5-3
  3. Orders shall set forth a time limit for compliance dependent upon the hazard created by the violation(s).

 

Sec. 97-06.9 Stop Work Order

Whenever the Fire Chief, or their designee, finds any work and/or construction in a Class 1 structure regulated by the Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other code of the jurisdiction being performed in a manner contrary to the provisions of those codes or in a dangerous or unsafe manner, and either of which creates a risk of fire or a hindrance to fire prevention, the Fire Chief, or their designee, is authorized to issue a stop work order. A failure to comply with a stop work order issued by the Rockville-Adams Township Fire Department may result in a fine up to One Hundred Dollars ($100) per day.

Sec. 97-06.10 Duty to Correct Violations

The owner or person in control of any premises or building upon which a violation or hazard exists as determined by the Fire Department pursuant to the Fire Prevention Code shall:

  1. Cease and correct the violation; and
  2. Protect persons and property from the hazards of the violation.

 

Sec. 97-06.11 Penalties

  1. Any person who shall violate any of the provisions of the Fire Prevention Code, or fail to comply therewith, or who shall violate or fail to comply with any order made there under, or who shall build in violation of any detailed statement of specifications or plans submitted and approved there under, or any certificate or permit issued there under, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Rockville­ Adams Township Fire Department or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of an ordinance violation, punishable by a fine of not more than One Hundred Dollars ($00).
  2. The imposition of one (1) penalty for any violation shall not excuse the violation or permit it to continue; all such persons shall be required to correct or remedy such violations or defected within a reasonable time. When not otherwise specified, each ten (1) days that the prohibited conditions are maintained shall constitute a separate offense.

 

Sec. 97-06.12 Appeal from Orders

An owner or occupant who remains aggrieved by an order or decision issued pursuant to this Fire Prevention Code and the matter involves a rule of the Indiana Fire Prevention and Building Safety Commission may appeal to the Indiana Fire Prevention and Building Safety Commission as set forth by I.C. 36-8-17.

Sec. 97-06.13             Local Fire Prevention Code Appeal Process

  1. Whenever the Fire Chief, or their designee, shall deny an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the Rockville-Adams Township Fire Prevention Code do not apply or that the true intent and meaning of the Rockville-Adams Township Fire Prevention Code have been misconstrued or wrongly interpreted, the applicant may, in addition to pursuing any other appeal/complaint process, appeal the decision of the Fire Chief, or their designee, to the Town Council within thirty (30) days from the date of the decision.
  2. The hearing on the appeal before the Town Council shall take place within thirty (30) days from the date of receipt of the notice of appeal. The decision of the Town Council shall be final.

Sec. 97-06.15 Disposition of Fess / Monies Collected

 

Monies generated from inspection, re-inspections, fees collected to the enforcement of a Stop Work Order, or any other fee, fine or damage award collected pursuant to this Fire Prevention Code shall be deposited into the Rockville Fire Prevention Non-Reverting Fund.

 

Appendix A:   Requirements for Fire Lanes

  1. General
  2. Clearances
  3. Signs

 

  1. General
  2. Fire lanes shall be provided and maintained in accordance with this section and any applicable exceptions listed herein. Fire lanes shall be required for every Class 1 structure to facilitate fire protection and provide access for firefighting equipment.
  3. Exceptions
  4. When a building is within fifty (50) feet of a public street, this section may be modified
  5. The provisions of this section may be modified. Provided, in the opinion of the Fire Chief, or their designee, that firefighting or rescue operations would not be impaired.
  6. Clearances
  7. The unobstructed width of an emergency fire lane shall not be less than twenty (20) feet
  8. Fire lanes shall have an unobstructed vertical clearance of not less than fifteen (15) feet
  9. Exceptions
  10. Upon approval by the Fire Chief, or their designee, the vertical clearance may be reduced provided such reduction does not impair access by firefighting apparatus and approved signs are installed and maintained indicating the established vertical clearance
  11. Permissible Modifications
  12. Vertical clearance or widths required by this section shall be increased when, in the opinion of the Fire Chief, or their designee, vertical clearances or widths are not adequate to provide fire apparatus access.
  13. Signs
  14. When required, approved signs or other approved notices shall be provided and maintained for fire lines and prohibit the obstruction thereof.

 

Appendix B: Fire Inspection Checklist –  Local Codes

 

  • Exit Signs

o  All Class 1 structures shall have exit signs on all egress doors

  • Exit signs can either be hard-wired or Glow-In-The-Dark Adhesive Backed
  • Fire Extinguishers

o  All Class 1 structures shall have at least one (1) fire extinguisher located in public areas

  • If Class 1 structure spans more than seventy-five (75′) feet in length, additional fire extinguishers may be required according to NFPA 10

o                Any Class 1 structure that uses cooking oil, shall have a Class K extinguisher

o  If Fire Extinguisher is 5.0 lbs. or less it does not have to be serviced by a Fire Protection Company, but it shall follow these guidelines:

  • Fire extinguishers must have a fire extinguisher tag and be checked monthly by employees
  • Fire extinguishers must be in “Full,” “OK,” or “Green Area” on the gauge
  • Fire extinguishers that are 5.0 lbs. or less are in service for ten (10) years, unless discharged for use and then have to be replaced
  • Fire extinguisher components must function correctly, if not, they shall be replaced regardless of size
  • Key Boxes

o   All new Class 1 structures located within the incorporated limits of the Town of Rockville shall have a key box, regardless of whether the Class 1 structure has a fire alarm system or sprinkler system

o               If any existing Class 1 structure has underwent a renovation of more than

25% of their structure, a key box shall be installed

 

  • Electrical

o No plug adapters shall be installed and used for permanent electrical outlet

  • Plug adapters shall be installed if they are grounded and screwed into original electrical outlet

o           All power taps (power strips) shall be surged and circuit protected

  • No appliances shall be plugged into any power tap (power strip) or power adapter
  • The Fire Chief, or their designee, shall have the authority to enforce provisions of the Indiana General Administration Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, this Fire Prevention Code, or any other rule of the Commission
