Legal Notice – SWP Community School Corporation Hearing of Proposed Lease
NOTICE OF HEARING ON PROPOSED LEASE
SOUTHWEST PARKE COMMUNITY SCHOOL CORPORATION
Notice is hereby given that a public hearing for the project described below will be held pursuant to Indiana Code 20-47-3-9 before the Board of School Trustees of Southwest Parke Community School Corporation (the “Board” and the “School Corporation,” respectively) upon a proposed lease, amendment to an existing lease or an amendment and restatement of an existing lease (the “Lease”) on July 12, 2023 at 7:00 p.m. at the School Corporation’s Central Office, 4851 South Coxville Road, Montezuma, Indiana 47862, between the School Corporation and Southwest Parke Community School Building Corporation (the “Building Corporation”), a school building corporation incorporated under Indiana Code 20-47-3. The Lease will permit the construction of all or a portion of the following (i) work on all or a portion of the School Corporation’s Riverton Parke Junior/Senior High School including, but not limited to, boiler improvements, upgrades and replacements, replacement of existing fire pumps, HVAC renovations, improvements, upgrades and replacements, sewage plant renovations, improvements, upgrades and replacements, building and building envelope door, window, wall and roofing renovations, improvements, upgrades, replacements and repairs, media center and art and science room renovations and other related renovations, improvements, upgrades, replacements and repairs; (ii) work on all or a portion of the School Corporation’s Montezuma Elementary School including, but not limited to, boiler improvements, upgrades and replacements, replacement of heating water distribution pumps, replacement of classroom unit ventilators, roofing renovations, improvements, upgrades, replacements and repairs, building door, window, wall and roofing renovations, improvements, upgrades, replacements and repairs, media center renovations, upgrades and improvements, and other related renovations, improvements, upgrades, replacements and repairs; (iii) work on all or a portion of the School Corporation’s Rosedale Elementary School including, but not limited to, boiler and related improvements, upgrades and replacements, replacement of chiller and related pumps, replacement of classroom unit ventilators, building door, window, wall and roofing renovations, improvements, upgrades, replacements and repairs, room wall acoustics improvements, media center and locker room renovations, upgrades and improvements, generator support network upgrades and improvements and other related renovations, improvements, upgrades, replacements and repairs; (iv) athletic field upgrades, including fencing improvements and upgrades; and (v) certain other renovations, improvements, upgrades, repairs, replacements and equipping at all School Corporation facilities ((i) through (v) collectively, the “Project”)
The Lease provides for a maximum annual rental with respect to the Project of $1,400,000 with annual rentals under the Lease payable commencing with tax years 2024 and ending no later than 2046.
As additional rental, the School Corporation shall maintain insurance on the Project as required in the Lease and shall pay all taxes and assessments against such property, as well as the cost of alterations and repairs. The plans and specifications, including statements of the cost of the Project, as well as a copy of the Lease are available for inspection by the public on all business days during business hours, at the School Corporation’s Central Office, 4851 South Coxville Road, Montezuma, Indiana 47862.
At the hearing for the Project described herein, all persons interested shall have a right to be heard on the necessity for the execution of the Lease with respect to the Project, and upon whether the lease rental provided for therein to be paid to the Building Corporation is a fair and reasonable rental for the proposed Project. The hearing may be adjourned to a later date or dates, and following the hearing, the Board may either authorize the execution of the Lease with respect to the Project as originally agreed upon or may make modifications thereto as may be agreed upon with the respective Building Corporation.
