By virtue of a certified copy of a Decree of Foreclosure to me directed by the Clerk of the Parke Circuit Court, Parke County, Indiana, in Cause No. 61C01-2107-MI-000256 wherein Robert Jones was Plaintiff, and CANDY APPLE FARMS, LLC is/are Defendant(s), in which action a judgment was rendered against the Defendant(s), and in favor of the Plaintiff and ordering me to sell the following real estate in Parke County and to apply the proceeds of said sale to the payment of said judgment, costs and accruing costs and to account for the balance to whomsoever is lawfully entitled. I will expose for sale at Public Auction to the highest bidder on the 16 day of March, 2023 at 1:30 PM. on said date at the office of the Sheriff of Parke County, 458 W. Strawberry Rd., Rockville, Indiana 47872, the real estate, together with the rents, issues, income and profits thereof located in Parke County, Indiana, the real estate which is legally described as follows:


Part of the Northeast Quarter (NE 1/4) of the Southeast (SE 1/4) of Section Twelve (12), Township Fifteen (15) North, Range Eight (8) West, Parke County, Indiana, more particularly described as follows:


Beginning 2193.70 feet N 00 degrees 10 minutes 00 seconds E of the southeast corner of said Southeast Quarter (SE 1/4), said point being marked by a 5/8″ reinforcing bar and running S 58 degrees 25 minutes 09 seconds W for a distance of 275.81 feet to a railroad spike, thence S 05 degrees 06 minutes 00 seconds W for a distance 64.94 feet to a 5/8″ reinforcing bar; thence N 50 degrees 40 minutes 46 seconds E for a distance of 31.18 feet to a 5/8″ reinforcing bar; thence N 89 degrees 35 minutes 44 seconds E for a distance of 37.60 feet to a 5/8″ reinforcing bar; thence N 83 degrees 57 minutes 20 seconds E for a distance of 75.98 feet to a 5/8″ reinforcing bar; thence N 02 degrees 21 minutes 17 seconds E for a distance of 8.93 feet to a point; thence N 73 degrees 30 minutes 12 seconds E for a distance of 60.68 feet to a 1″ diameter iron pipe; thence N 00 degrees 10 minutes 00 seconds E for a distance of 137.95 feet to the point of beginning, containing 0.517 acres, more or less.

A part of the Northeast Quarter of the Southeast Quarter of Section 12, Township 15 North, Range 8 West, Parke County, Indiana, and being that part of the grantors land lying within the right-of-way lines described as follows:

Commencing at the southeast corner of said section, designated as point “230” on the Location Control Route Survey Plat recorded in Instrument 2002390, Volume 85, Page 165, in the Office of the Recorder of said county; thence North 1 degree 01 minute 43 seconds East 663.922 meters (2,178.22 feet (2,193.7 feet by Deed Volume 183, page 256) along the east line of said section to the southeastern boundary of Mecca Road; thence South 60 degrees 54 minutes 27 seconds West 47.761 meters (156.70 feet) along the boundary of said Mecca Road and along the southeastern boundary of U.S.R. 41 to point “683” and the point of beginning of this description: thence Southwesterly 38.079 meters (124.93 feet) along an arc to the right and having a radius of 167.000 meters (547.90 feet) and subtended by a long chord having a bearing of South 54 degrees 17 minutes 18 seconds West and a length of 37.996 meters (124.66 feet) to the western line of the grantors land; thence North 7 degrees 00 minutes 02 seconds East 5.420 meters (17.78 feet) to the southeastern boundary of said U.S.R. 41; thence North 60 degrees 54 minutes 27 seconds East 34.550 meters (113.35 feet) along the boundary of said U.S.R. 41 and said Mecca Road to the point of beginning and containing 0.0103 hectares (0.025 acres), more or less.
