ORDINANCE 2021-13
PARKE COUNTY COMMISSIONERS
AN ORDINANCE AMENDING THE SALARY ORDINANCE AND EMPLOYEE HANDBOOK TO ADD OVERTIME PAY FOR SPECIFIC PARKE COUNTY PUBLIC SAFETY POSITIONS
WHEREAS, Indiana law empowers local governing bodies to adopt the necessary ordinances and resolutions to provide for the effective governance of the unit [I.C. 36-1-3 (Home Rule)]; and
WHEREAS, The Parke County Council (“Council”) is empowered with the duty to fix the annual compensation of all appointed officers, deputies and employees under its jurisdiction, pursuant to I.C. 36-2-5-3; and
WHEREAS, The Council has determined that it is in the best interests of Parke County and its citizens to compensate specific employees of the Parke County Units of Government with overtime pay to compensate them for their time worked in service to the County and its citizens and in so doing has passed a resolution recommending that the Parke County Board of Commissioners adopt an ordinance authorizing said compensation; and
WHEREAS, The Parke County Board of Commissioners desire to adopt this Ordinance to establish a policy to compensate specific employees of the Parke County Units of Government for overtime.
NOW THEREFORE BE IT ORDAINED, by the Parke County Board of Commissioners that the following positions be eligible for overtime compensation, in lieu of compensatory time:
- Dispatchers
- Dispatch Supervisor
- Jail Officers
- Jail Officer Supervisors

Further, this recommendation is contingent upon the agreement and understanding that normal staffing levels as of the date of adoption of the 2022 Parke County Budget, which was on October 14, 202l, shall not be increased without express permission and agreement by both the Parke County Board of County Commissioners and the Parke County Council.
Further, the Sheriff of Parke County shall report to the Auditor of Parke County by December 31, 2021, the amount of compensatory hours that have been accumulated by employees in the above positions. The Auditor shall compensate these employees for their accumulated compensatory hours at the hourly rate which they would earn in calendar year 2021.
The Parke County Council shall ensure that adequate funding is available to support this policy while this Ordinance is in effect.
