Public Notice-Advertisement for Bids







Notice is hereby given, that the Town of Mecca, Parke County, Indiana, by and through its Town Council, hereinafter referred to as the Owner, will receive sealed bid packets for the construction of the Town of Mecca’s New Park Project.


Sealed bids should be mailed or delivered to Curry & Associates, Inc. at 110 Commerce Drive, Danville, IN 46122. Sealed bids must be received by Curry & Associates, Inc. no later than 4:00 p.m. local time, on October 25th, 2021. Bids received after said time will be returned unopened. Bids will be publicly opened and read aloud at a public meeting at 10:00 a.m. local time, on October 26th, 2021 at the Mecca-Wabash Township Volunteer Fire Department – Fire House located at 4882 Wabash Street, Mecca, Indiana 47860. All interested citizens are invited to attend and should any citizens require special provisions, such as handicapped modifications or non-English translation personnel, the Town will provide such provisions as long as the request is made to Ms. Kristy Jerrell, Grant Administrator, at (812) 878-0826, 1 week prior to the meeting.


A Pre-Bid Conference will be held on October 5, 2021 at 10:00 a.m. local time, at the Mecca- Wabash Township Volunteer Fire Department – Fire House located at 4882 Wabash Street, Mecca, Indiana 47860. All prime contractors, subcontractors, small, minority and Woman Business Enterprises and other interested parties are invited to attend.


The Town of Mecca’s New Park Project involves the construction of 590 SYD new stone drive and parking area, 45 SYD asphalt parking area, 210 SYDS of 5’ wide asphalt path and park bench areas, 550 SYD basketball court, 90 LF of 6 foot tall chain link fence, 16’ x 14’ park shelter with concrete pad, installation of swing set and play area equipment supplied by owner, installation of 240 LF of rubber curb playground border, one 20’ tall security light, one bicycle rack, one 9’ long 4 low riser high bleacher assembly. In addition to these items of work there are other miscellaneous items of work necessary and as specified to make the Project complete.

Paper copies of the plans may be obtained by Bidders at the office of Curry & Associates, Inc., 110 Commerce Dr., Danville, IN 46122, upon payment of $180.00 for each set. No refunds will be made for returned plans.

No Bidder may withdraw his bid within 60 days after the actual date of opening thereof.


The work to be performed and the bid to be submitted shall include sufficient and proper sums for all general construction, mechanical & electrical installation, labor, materials, permits, licenses, insurance, and so forth incidental to and required for the construction of the facilities.


Each bid must be enclosed in a sealed envelope bearing the title of the Project and the name and address of Bidder. All bids must be submitted on the bid forms as identified in the Contract Documents and Specifications.


Each proposal shall be accompanied by a bid guaranty conforming to the Indiana Revised code. Said bid guaranty shall be a certified check in an amount equal to five percent (5%) of the Bid; or a bid bond for five percent (5%) of the Bid as surety for the execution of the contract. The bond or certified check should be made out to the Town of Mecca. A bid bond form is included in the bidding documents.


Approved performance and payment bonds guaranteeing faithful and proper performance of the work and materials, to be executed by an acceptable surety company, will be required of the Contractor at the time of contract execution. The bonds will be in the amount of 100% of the Contract Price and must be in full force and effect throughout the term of the Construction Contract plus a period of twelve (12) months from the date of substantial completion.


The Owner reserves the right to reject any bid, or all bids, or to accept any bid or bids, or to make such combination of bids as may seem desirable, and to waive any and all informalities in bidding. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. Any bid received after the time and date specified shall not be considered. No bid may be withdrawn after the scheduled closing time for receipt of bids for at least sixty (60) days.


A conditional or qualified Bid will not be accepted.


Award will be made to the low, responsive, responsible bidder. The low, responsive, responsible bidder must not be debarred, suspended, or otherwise be excluded from or ineligible for participation in federally assisted programs under Executive Order 12549.


All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout.


Bids shall be properly and completely executed on bid forms included in the Specifications. Bids shall include all information requested by Indiana Form 96 (Revised 2010) included with the Specifications. Under Section III of Form 96, the Bidder shall submit a financial statement. A copy of the proposed Financial Statement to be submitted with the bid is included in the bid documents section to these specifications. The Owner may make such investigations as deemed necessary to determine the ability of the Bidder to perform the work and the Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.


Each Bidder is responsible for inspecting the Project site(s) and for reading and being thoroughly familiar with the Contract Documents and Specifications. The failure or omission of any Bidder to do any of the foregoing shall in no way relieve any Bidder from any obligation with respect to its Bid.


The project is not subject to the Davis Bacon Act and contractors are not bound to construction wage rates established by the U.S. Department of Labor. With the repeal of the Common Construction Wage Act (Indiana’s Prevailing Wage Law), the Indiana General Assembly added new requirements for public works construction contractors including:

–Tier 1 (General or Prime) Contractors must contribute at least 15% of the contract price in work, materials, services or any combination thereof

–Contractors cannot pay employees in cash

–Contractors must E-Verify each employee on a project

–Contractors must certify that they are in compliance with the federal Fair Labor Standards Act (FLSA) and the Indiana Minimum Wage Law

–Contractors may be required to have a drug testing program in accordance with IC 4-13-18

–Contractors must maintain required levels of general liability insurance


The Contractor must meet guidelines and practices established by the Indiana Department of Natural Resources Land and Water Conservation Fund Program and appropriate state and federal regulations including: 1) Executive Order 11246 (Equal Employment Opportunity), 2) Certification of Non-Segregated Facilities, 3) Title VI of the Civil Rights Act of 1964, 4) Section 504, Rehabilitation Act of 1973, 5) Age Discrimination Act of 1975, 6) Conflict of Interest Clause, 7) IC-36-1-12 and others that may be appropriate or necessary. The Bidders shall also comply with the requirements of 41 CFR Part 60 – 4 entitled Construction Contractors – Affirmative Action Requirements.
