PARKE COUNTY ORDINANCE

#2019-24

AN ORDINANCE adjusting the State prima facie speed limit.

WHEREAS, the Parke County Supervisor has conducted an engineering and traffic investigation as to the establishment and regulation of the speed limit for vehicles on County Road Warrior Road starting 0.036 miles South of SR 47 and ending 0.270 miles South of SR 47, said road section is 0.234 miles in Parke County, Indiana;

AND WHEREAS, on the basis of said investigation relative to special hazards and safety, it has been determined that the reasonable and safe maximum speed limit for vehicles on the above County Road, is less than the State prima facie  speed limit as set forth in I.C. 9-21-5-2;

THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF PARKE COUNTY, INDIANA, PURSUANT TO I.C. 8-17-1-40 AND I.C. 9-21-5-6 THAT:

The reasonable and safe maximum speed limit for Parke County Road Warrior Road from 0.036 miles South of SR 47 and ending 0.270 miles South of SR 47 has been decreased from the state prima facie speed limit, as properly authorized by state law, on the basis of an engineering and traffic investigation relative to special hazards and safety, to twenty (20) miles per hour.

BE IT FURTHER ORDAINED, that any person violating the speed limit as described in this section shall be cited and prosecuted for a Class C Infraction.

BE IT FURTHER ORDAINED, that this Ordinance shall be in full force and effect upon passage and approval by the Parke County Board of Commissioners and legal publication thereof.

DULY ADOPTED this 7th day of October 2019.
