AN ORDINANCE FOR THE TEMPORARY CLOSURE OR RESTRICTIONS OF COUNTY ROADS

WHEREAS, it has been brought to the attention of the Commissioners of Parke County, Indiana that weather changes in the Winter and Spring of each calendar year, including freezing and thawing, causes damage to County Roads, especially when vehicles of certain weights and size are driven on county Roads, and

WHEREAS, the County Commissioners previously adopted an Ordinance authorizing the County Road Superintendent to post weight limits on County Roads, and

WHEREAS, the County Commissioners have determined that said previous Ordinance needs to be supplemented,

NOW, THEREFORE, BE IT ORDAINED by the Commissioners of Parke County, Indiana:

  1. Whenever the Board of Commissioners, in conjunction with County Highway Superintendent, determines that County Roads will be seriously damaged or destroyed by reason of deterioration, rain, snow, or other climatic conditions, the Board of Commissioners, or its designee, the County Highway Superintendent, may declare any or all County Roads temporarily closed to traffic, or may prohibit the operation of trucks or commercial vehicles on any County Roads, or may impose limitations as to the weight, size, or use thereof on County Roads.
  2. Whenever the Board of Commissioners determine that the need exists to close any or all County Roads or to impose weight, size, or use restrictions upon any County Roads, notice of such closure or restriction-shall be given to the appropriate news media and/or appropriate signs shall be erected and maintained designating the appropriate restriction. The closure and/or restriction shall be effective upon publication and/or erection of any signs.
  3. Public Safety and Emergency Vehicles shall be excepted from the provisions of this Ordinance.
  4. Violations of the closure of any County Road or of the weight, size or use restrictions imposed upon any or all County Roads shall be considered a Class B Infraction and punishable by a fine not to exceed $1,000 per occurrence.

Unanimous consent of Parke County Commissioners who were present on the 4th day of March 2019 to consider the ordinance on the same date as introduced.
