SUMMONS AND NOTICE BY PUBLICATION

This Summons and Notice is to any interested or concerned person identified above, and to all other persons who may be interested or concerned about the subject matter of this action and the real estate described below.

All interested or concerned persons who are collectively identified as The Whole World, are notified that they have been sued by Plaintiff Thomas L. Sanders in the Parke Circuit Court, 116 West High Street, Room 204, Rockville, Indiana 47862, telephone (765) 569-5132, in an action entitled Thomas L. Sanders v. Judy Sanders, et al, Cause Number 61-C01-1901-PL-000020.

The above-described civil action has not yet been scheduled for a trial or hearing. A trial or hearing date will not be set until after the expiration of the time period for the filing and service of an answer to the complaint.

This Summons and Notice by publication is specifically directed to any and all persons, known or unknown, in the whole world who claim or may claim an interest in the Real Estate described below. The other defendants identified by name in the caption for this action are being served with separate Summonses by other means.

In his individual capacity as the Plaintiff, Thomas L. Sanders is being represented by Jeffrey S. Dible, Atty No. 4673-79, Frost Brown Todd LLC, 201 N. Illinois Street, P.O. Box 44961, Indianapolis, IN 46244-0961. Mr. Dible may be contacted at (317) 237-3811.

The nature of this action against any persons, known or unknown, who may claim an interest in the subject Real Estate, is (1) an action to quiet the title of Thomas L. Sanders, who asserts a superior interest in the Real Estate under the probated Last Will of Ronald Sanders, and (2) an action to set aside a certain Quitclaim Deed recorded in May 2014.

The Subject Real Estate involved in this action consists of the following parcels of real estate in Parke County, Indiana, corresponding to Tax Parcels 61-10-31-000-103.00-016 and 61-10-30-000-302.000-16, and consisting of 69.82 acres plus 35.75 acres, or 105.57 legal acres in all:

 

Commence at the Southwest corner of the East Half of the Northwest Quarter of Section 31, Township 15 North, Range 8 West; thence North 204 rods; thence North 49 degrees East 52 poles; thence East 42 poles; thence South 240 poles; thence West 80 poles to the place of beginning, containing 115.75 acres, more or less.

 

EXCEPT, commence at the Northwest corner of the East Half of the Northwest Quarter of Section 31, Township 15 North, Range 8 West; thence East 4 chains (264 ft.); thence South 13 chains and 94 links (920 ft.) to the centerline of County Road 400S; thence West 4 chains (264 ft.); thence North 13 chains and 94 links (920 ft.) to the place of beginning, containing 5.58 acres, more or less.

 

EXCEPT, commence at the Northwest corner of the East Half of the Northwest Quarter of Section 31, Township 15 North, Range 8 West; thence East 4 chains (264 ft.) to the place of beginning; thence East 3.03 chains (200 ft.); thence South 10.15 chains (670 ft.); thence Southeast to the centerline of County Road 400S; thence West 4.92 chains (325 ft.) thence North 13.94 chains (920 ft.) to the place of beginning, containing 4.60 acres, more or less.

 

Plaintiff asserts a title to or rights in the above-described Real Estate that is superior to any other claim or interest.

An answer or other response in writing to the Complaint by Plaintiff Thomas L. Sanders must be filed by either you or your attorney within thirty (30) days after the third (3rd) publication of this Summons in this newspaper, and if you fail to timely respond in writing, judgment by default may be entered against you for the relief demanded by the Plaintiff.
